House Rule No.3 was validly enacted under s.70(2) SMA 2013 for legitimate regulatory purposes and did not contravene s.70(5) because the short‑term rentals operated by the appellants were licences (transient occupancies akin to hotel/lodger arrangements) and therefore did not constitute ‘dealings’ (tenancies or tenancies exempt from registration) protected by s.70(5); consequently enforcement of the House Rule was lawful and the appeal was dismissed.
