Clause 13.3 of the account Terms and Conditions unambiguously authorised the bank to debit the plaintiff's current account without prior notice to recover monies wrongly credited by the bank; the funds were the bank's, the debit was a lawful exercise of that contractual right, the bank did not act negligently in making the debit, and the plaintiff failed to prove any loss causally attributable to the debit; accordingly the plaintiff's claim fails.
