On the facts the respondent was constructively arrested before providing the urine specimen; the Magistrate erred in finding non-compliance with s31A and in concluding defence raised reasonable doubt; appeal allowed and conviction entered.

The court found prosecution proved all elements of the offence under Section 15(1)(a) DDA beyond reasonable doubt: lawful collection under Section 31A, credible laboratory confirmation of amphetamine and methamphetamine, and an unbroken chain of custody; the serial number discrepancy was a human typographical error explained by the analyst and did not break the chain; ID10/ID11 were excluded as afterthoughts; single bottle collection was legally sufficient; defendant failed to rebut the presumption under Section 37(k).

Conviction was upheld because the prosecution proved a prima facie case and the urine sample and chemical analysis were reliable notwithstanding use of a single bottle and absence of an explicit statement invoking s.37(k); however the sentence was quashed and substituted because the Magistrate failed to give appropriate weight to the statutory rehabilitation scheme and first-offence mitigation, warranting reduction to a fine with supervision under s.38B.
