The appeals were allowed because (1) the 35 charges under section 420 were defective and occasioned a failure of justice as the prosecution case and documents showed material payments to a third party (Ganang Resources) contrary to the charge particulars, and sections 156 and 422 do not cure a defect that misled the accused; and (2) on maximum evaluation of the prosecution evidence the totality of contemporaneous documents and bank records supported the inference of a friendly loan and substantial repayments, creating reasonable doubt as to deceit such that convictions were unsafe and had to…
