Plaintiff failed to discharge the burden of proof on a balance of probabilities, refused to give oral evidence and therefore suffered an adverse inference under s.114(g) EA 1950; moreover the ownership of the disputed safe deposit boxes had been finally determined by the 2003 High Court order and the present claims are barred by res judicata — accordingly the Plaintiff's claim is dismissed.
