The Plaintiffs proved serious irregularities in the removal and appointment process, including failure to regularise membership and to convene a valid AGM; the unilateral changes and alteration of ROS records were unconstitutional and void; the High Court retains jurisdiction to grant declaratory and injunctive relief despite Section 16 of the Societies Act; accordingly the Plaintiffs (First Plaintiff as Secretary and First Defendant as President) are reinstated solely to convene a lawful AGM within two months, ROS must rectify its records, and costs were awarded.
