Court of Appeal held that s.60(1)(a) Sarawak Land Code plainly requires market value to be taken at date of publication of the s.47 notification where one exists; High Court erred in using s.48 date; delay may be addressed by upward adjustment within the statutory framework but cannot change the valuation date; accordingly the High Court judgment was set aside and the Superintendent's award reinstated.
