Appeal allowed because the officer (SD4) who issued the detention order was not joined as a defendant, precluding a successful tort claim against the Government under ss 5 and 6 Government Proceedings Act as established in Lay Kee Tee; alternatively, SD4 had reasonable grounds to revoke the release and lawfully place the plaintiff under close arrest under applicable provisions, so the Judicial Commissioner’s findings were wrong and set aside.
