Convictions and sentences are upheld because the cannabis weight (52.58g) exceeded the 50g threshold triggering mandatory minimum penalties under s39A(2) of the Dangerous Drugs Act 1952; the guilty plea and mitigation were considered but could not lawfully reduce the sentence below the statutory minimum, therefore five years imprisonment with ten strokes for the cannabis charge and nine months concurrent for the methamphetamine charge are appropriate and not manifestly excessive.
