Because the Federal Court in AmBank held that bankruptcy proceedings are fresh proceedings and not writs of execution under Order 46 r 2, the application under Order 46 r 3 (Lamp 20) was defective; Limitation Act governs enforcement by bankruptcy and provides a 12-year period to commence such proceedings, therefore the Lamp 20 application seeking leave under Order 46 was dismissed.
