Court found on balance of probabilities that negotiations had been aborted, the alleged SPA was a sham created by a tri-partite conspiracy (fraudulent purchaser Siva, fraudulent agent Thevan, and an unqualified/forging conveyancer Usha and her firm); Firwas never accepted or signed the SPA; caveat lodged by Siva was wrongful; Firwas entitled to removal of caveat, damages for loss of use/opportunity (interest at 8% p.a. on RM52,200,000 from accrual date until 14 days after caveat removal), exemplary damages, and indemnity costs against the fraudsters.

Defendant had no caveatable interest because the transfers relied upon were previously declared forged and void and the register restored to the plaintiffs in 2010; the caveat lodged by the Defendant in 2015, absent any nexus or evidence, could not be maintained. Removal of the caveat was justified and damages were awarded for wrongful deprivation of use of the land: RM12,000 per annum from 19 August 2015 with 5% p.a. interest until full settlement; costs awarded to the Plaintiffs.
