The Federal Court held prosecution failed to prove murder under s.302 via s.300(c) beyond reasonable doubt because expert forensic evidence was reasonably controverted and SP6's conclusions were equivocal; however, evidence including credible eyewitness testimony proved appellants intentionally inflicted injury and were liable for culpable homicide not amounting to murder under s.304(a), and abetment by Abdoul Hakeem was established, so High Court convictions under s.304(a) and abetment were restored and sentences of 18 years imprisonment upheld.
