Having weighed all factors under the expanded judicial discretion post-Act 846, the court found that mitigating factors (first offender, cooperation, not caught selling, no agent provocateur, not involved in processing) outweighed aggravating factors and that the appropriate sentence under Section 39B(2) is imprisonment for life and 15 strokes of whipping; 'life imprisonment' is to be read as 30 years under the Criminal Justice Act s.3.
