The Court dismissed leave because the High Court's order remitting the case for retrial did not 'finally dispose of the rights of the parties' within the meaning of 'decision' in s3 Courts of Judicature Act 1964 and therefore the appeal would not be competent under s50(2); accordingly leave to appeal was refused though the High Court's power to order retrial under revisionary jurisdiction was affirmed.
