The court found plaintiffs had raised bona fide serious questions and that damages were not an adequate remedy; the defendant failed to demonstrate a sufficient level of risk of loss or that the plaintiffs' undertaking was worthless; there was no evidence of plaintiffs' bad faith and the defendant breached the ad interim injunction; accordingly the inter partes application for an interim injunction was allowed and the defendant's applications to set aside the ad interim injunction and to require RM20,000,000 fortification were dismissed.
