The court applied the Strata Titles Act as amended by A1450 (effective 1 June 2015) and found the developer had taken reasonable steps since 2010 to obtain necessary alienation, amalgamation and approvals; delays were substantially caused by statutory and administrative requirements outside the developer's control and prerequisites to a valid strata application had not been met; the contractual clause limiting vendor liability for delay applies; declaratory and mandatory relief was therefore premature and unjustified.
