The High Court reversed the Registrar because the Defendant’s composite mark POLOPALOOZA with a prominent polo-player device reproduced the essential, dominant features of the Plaintiff’s registered POLO/polo-player device: visual, aural and conceptual similarities combined with identical goods in Class 18, the Plaintiff’s reputation, and the principle of imperfect recollection create a real and tangible likelihood of confusion under s14(1)(a) and satisfy s19(1)(a) and (b); accordingly the application was refused and the Registrar’s decision set aside.
