On the balance of probabilities the admitted medical report, post-mortem, death certificate and photographic evidence establish that the deceased died from being hit by a fallen tree and that negligence in maintenance under s101 LGA is established; the Magistrate's finding to the contrary is set aside and the matter is remitted to the Magistrate’s Court to determine which defendant is liable under s101 and to assess damages and other reliefs.
