The court found that the defence successfully rebutted the presumption under Section 37(d) ADB on the balance of probabilities by showing that the seized drugs were in an open, third‑party accessible location, there were material doubts about the voluntariness and authorship of P12, absence of forensic links and contradictions in police testimony; as a result prosecution failed to prove control and knowledge beyond reasonable doubt and the accused was acquitted.
