The Federal Court dismissed the appeal and affirmed the Court of Appeal because the 2013 suit was barred by res judicata in the wider sense: the cause of action, subject matter and issues were identical or substantially similar to those in the 1997 proceedings and the new issues could have been raised earlier; therefore relitigation was barred and other questions (limitation, trust, unjust enrichment, estoppel) were unnecessary to decide.
