Affidavits with incorrect endorsement may be used where the defect is not serious and did not mislead the court; the plaintiff’s cause of action against the 3rd and 4th defendants accrued no later than July 2005 when he knew the material facts, and therefore the claim against those public authority defendants is statute‑barred under the Public Authorities Protection Act 1948; conversely, the pleaded averments raised a plausible cause of action against the 2nd defendant arising in 2016–2017 so the strike‑out application against the 2nd defendant failed.
