On the balance of probabilities the court found that the defendant, through its director present at the 15.11.2018 meeting, agreed to return the land and to pay RM80,000 in damages; the subsequent completion of the transfer and the solicitor's confirmation, together with the defendant's failure to notify refusal, established a binding agreement despite the defendant's later denial; SP1 had direct knowledge of the meeting and was competent to testify; accordingly the plaintiff's claim succeeded and costs were awarded.
