On the balance of probabilities the court found Defendants 2 and 3 made false representations (as agent/director of Defendant 1), failed to transfer the RM200,000 to Defendant 1 and could not satisfactorily explain material discrepancies in invoices and receipts dated 2022; accordingly Plaintiff's claim against Defendants 2 and 3 succeeds and they are liable to repay RM200,000 with interest and costs.
