Confined to the pleadings, the statement of claim discloses no material facts establishing personal liability by the 1st Defendant: all alleged acts were performed in his official capacity for the 2nd Defendant; he was not proprietor nor party to the agency agreement in his personal capacity; privity of contract bars a personal claim; naming him personally without pleaded basis amounted to abuse of process. Accordingly the personal-capacity claim was plainly unsustainable and struck out; SOC amended to reflect representative capacity only and costs awarded to 1st Defendant.
