The appellate court dismissed the appeal because the learned Sessions Court Judge's factual findings were supported by credible witness testimony and documentary evidence (bank transfers, company records, WhatsApp messages) which the defendant failed to rebut; under established principles appellate interference is unwarranted unless the trial judge is plainly wrong or failed to appreciate evidence, which was not shown here; therefore the Sessions Court's decision was affirmed and costs awarded.
