On the balance of probabilities the written sale was a genuine sale concluded at RM850,000 and fully effectuated by Defendant who paid sums exceeding that amount (including deposit, instalments and redemption); Plaintiffs failed to prove the sale was a sham or that documents were forged; solicitors acted under an implied retainer to obtain redemption and complete the transaction; accordingly Plaintiffs' claims fail and are dismissed with costs.
