On the balance of probabilities the plaintiff failed to prove defendants breached the Purchase Order or that defendants had the contractual duty to prepare the JMS; the Purchase Order terms (including delivery) were general and not an agreed strict deadline; plaintiff wrongfully terminated the contract without clear contractual right or prior notice; defendants succeeded on their counterclaim and were awarded costs of RM5,000 and interest at 5% p.a. from date of judgment until full settlement.
