The appeals were dismissed because the Sessions Court correctly struck out the 1st Defendant's third party pleadings: there was no cause of action against PKNP due to absence of privity and pleaded alter‑ego facts were insufficient to impose contractual liability on PKNP; the claim against Taipan Merit was frivolous and an abuse of process because it sought contribution and indemnity under a different contract, for a larger sum and arising earlier than the plaintiff's claim, so contribution/indemnity could not arise.
