The appeal is dismissed because the Sessions Court Judge’s ruling on the preliminary objection was a non‑appealable ruling made in the course of trial under s.3 CJA; on the merits the Consent Judgment’s bar on relying on limitation applied to the Declaration Action (the fresh writ) and not to the negligence suit, and in any event the 3rd Defendant failed to plead limitation and therefore could not raise it at trial.
