Appellate court found trial court had evidence of deceased's earnings and itemised expenditures; 1/3 deduction is not mandatory and must be adjusted on facts. Having assessed evidence, the High Court set the dependency at one-half of the net income (RM585 per month based on RM1,170 net), awarded total dependency damages of RM112,320 for 196 months and ordered costs of RM3,000 to the appellant because the trial court had erred in its assessment of quantum.
