The High Court upheld the Sessions Court's finding that the default judgment was regular, the appellant had no arguable defence on the merits, and the unexplained six-year delay in seeking to set aside the judgment justified refusal of the application; accordingly the appeal was dismissed and costs awarded to the respondent.
