The court found FELDA acted in accordance with its records and governing pekeliling in appointing Fatimah as substitute in 1982; plaintiffs failed to show the appointment was unlawful or that FELDA exceeded jurisdiction; plaintiffs' delay meant claims against FELDA were statute-barred and including FELDA as a defendant constituted an abuse of process, therefore the writ, statement of claim and claim against Defendant No.4 were struck out with costs.
