Because the amounts alleged to be due were disputed and subject to pending litigation, the plaintiffs were not shown to be in arrears as required to trigger statutory disqualification; the JMB exceeded its statutory powers by barring voting and only the Commissioner of Buildings (or authorized public officer) could exercise enforcement powers under the Act; therefore the three AGMs were invalidated.
