Prosecution failed to establish a prima facie case on s379A and s414 because material gaps and unexplained evidence (notably failure to investigate or call owner Lee Moi Yock and payee 'Andrew', unresolved provenance of payments, timing inconsistencies and absence of proof of dishonest intent) undermined mens rea and the narrative; therefore it was unsafe to call accused to enter defence and accused was acquitted and discharged without being called to defend.
