On the balance of probabilities the court found defendants 1–3 lacked lawful authority during the relevant period, failed to produce proper accounts or deposit collected cash, obstructed audits and violated provisions of the Strata Management Act 2013 and its regulations; accordingly they were jointly and severally liable for the misappropriated sum of RM1,010,195.61 and liable for the RM325,000 settlement paid to defendant 4.
