The defendants filed their extension application after an undue and substantial delay (64 days) and offered frivolous and inadequate reasons (winding up, lack of instructions, belief matters would be handled by Insolvency Department) while their conduct obstructed the audit and led to release of RM200,000 in breach of the consent order causing clear prejudice to the plaintiff; there was therefore no material to justify exercising discretion to extend time and the application was dismissed.
