The management agent, as authorised through the JMC and successor arrangements, lawfully may collect maintenance arrears; however the agent and JMB lacked legal authority to cut the water supply which is a function of the statutory water authority, and the unlawful disconnection constituted a tortious trespass for which nominal damages of RM5,000 were appropriate; the appellant first is liable on the counterclaim for arrears of RM10,492.10 and the second appellant is not liable.
