Leave to commence judicial review was granted because on perusal of the material the application was not frivolous or vexatious and disclosed an arguable case fit for full inter partes investigation; the challenge related to the decision to hold a new inquiry on 7 November 2023 (procedural act) rather than the quantum of compensation determined in land reference proceedings, so multiplicity of proceedings did not bar leave; accordingly a stay of the land reference proceedings was ordered until disposal of the judicial review.
