The court struck out the Amended Originating Summons for failure to obtain mandatory leave under Order 20 r.5/r.7 and for tactical amendment after a strike‑out application; found the Notice of Termination defective and the purported termination invalid; construed Clause 3 as creating a mandatory renewal right (subject to its conditions) which prevails over the ambiguous ‘Nil’ entry in the First Schedule and over a narrow reading of Clause 5; consequently the Appellant’s refusal to vacate was not a breach and the appeals succeed.
