The plaintiff failed to disclose a circumstance that might give rise to a claim (the Ketamine overdose and internal inquiry) which it admitted it knew on 07.12.2015 prior to inception of the MMIT; that omission breached the express basis clause and the Duty of Disclosure and, under Clause 2.1.5, the claim was excluded and the defendant was entitled to repudiate the certificate. Accordingly the plaintiff's claim for indemnity is dismissed with costs.
