On the evidence and on a balance of probabilities the plaintiffs proved birth in Malaysia and biological ties to Malaysian relatives; the defendants failed to disprove those ties or show plaintiffs were citizens of another country; therefore plaintiffs satisfy Article 14(1)(b) read with Section 1(a) of the Second Schedule (alternatively section 1(e)) and are citizens by operation of law; JPN/Registrar should have facilitated registration and solemnisation rather than deny and thereby perpetuate generational statelessness.
