Material inconsistency between the pleaded Facts and the charge, failure to demonstrate compliance with s.399 CPC regarding service of the chemist report and the non-production/uncertain identification of exhibits together undermined the safety and legality of the convictions entered on the guilty plea; accordingly the High Court, having jurisdiction to review such convictions, set aside the convictions and sentences and remitted the matter to the Sessions Court for trial.
