The JMB had locus standi to sue under s143 SMA 2013 and the Plaintiff proved that the Defendant deviated from the Original Approved Building Plan (missing fire doors and wet riser) and failed to permanently rectify recurring defects in the common property; accordingly the Plaintiff's claims for specified rectification costs succeeding while the mandatory injunction to compel the 0.5% deposit and claims for general damages were refused; interest and costs awarded to Plaintiff.
