Application to transfer was dismissed because the real cause of action concerns unpaid commissions and payment arrangements which took place in Selangor; the court only needs to determine breach of the agreement and related banking transactions in Selangor and not investigate the Melaka development; logistical inconvenience and location of witnesses were not material and, after weighing Order 57 r.1(4) factors, transfer was not justified; consequently the stay was also refused.
