There was a bona fide serious issue to be tried regarding authority to collect maintenance and sinking fund contributions after establishment of the JMB; the balance of convenience favoured the defendant because continued collection by the plaintiff risked prejudicing the JMB and owners and no adequate alternative remedy existed; accordingly an interlocutory injunction was granted to preserve the status quo with costs to follow the cause.
