Court found defendants (JKR/Jurutera Daerah and State Government) owed a duty to ensure the state road was safe, that this duty included removing or warning of hazards on the carriageway even if the fallen lamp post was owned by MBJB or maintained by a concessionaire; defendants breached that duty by failing to ensure the lamp post was removed or adequately warned against, the breach caused the accident which induced stress reasonably leading to the deceased's fatal heart attack, and plaintiff established causation and damages. Contributory negligence of the deceased assessed at 20%.
