The Registrar was correct to dismiss the applicant's invocation of declaratory relief and to require compliance with the Insolvency Rules; failure to serve creditors under Rule 19 justified dismissal; because the 16.9.2008 order was a conditional discharge under s.33(10) and its conditions remain unmet (judgment for RM38,357,405.63 outstanding), the applicant remains a bankrupt and KPI may record that status administratively without a fresh court order; appeal dismissed with costs.
