The Court upheld the High Court: the plaintiff had adduced sufficient affidavit evidence to disclose a caveatable interest because an oral condition attached to the gift raised serious questions to be tried; the oral condition was admissible under exceptions to section 92 Evidence Act for interlocutory determination; on balance of convenience the caveat should be extended and the High Court order was not a misapplication of principle and therefore the appeals were dismissed.
