Applying the Prince Jefri Bolkiah test the Court found no solicitor-client relationship between NN/WWW and the Respondent because NN represented Ms Chan (who ceased to be director/shareholder in 2014) not the company; the only specific material relied upon by the Respondent was a paragraph of an email which originated from public Companies Commission of Malaysia records and was not confidential; the Respondent failed to particularise confidential information or show a real risk of disclosure that could prejudice it; accordingly the disqualification application was dismissed and costs awarded.
