The Court held the preliminary and final determinations were tainted by Wednesbury unreasonableness because the MITI Minister signed notices recommending affirmative determinations before the IA had completed and issued the corresponding investigation reports; this showed a failure to take into account the relevant IA reports and amounted to pre-judgment, rendering the determinations amenable to judicial review and allowing the application to quash those determinations.
